The 501(c)(3) Process
Here is a general overview of the steps involved in forming a tax-exempt nonprofit organization.

Define Your Mission

Choose a Name & Structure
Select a unique name for your nonprofit and determine the appropriate organizational structure.

Incorporate in Wisconsin
File Articles of Incorporation with the Wisconsin Department of Financial Institutions to establish your legal entity.

Draft Bylaws & Policies
Create governing documents including bylaws, a conflict of interest policy, and board member roles.

Obtain an EIN
Apply for an Employer Identification Number (EIN) from the IRS — required before filing for tax-exempt status.

File IRS Form 1023
Submit Form 1023 or 1023-EZ to the IRS to apply for federal tax-exempt status under Section 501(c)(3).
